Terms of Service

These Terms apply to use of the Loylo website and Loylo platform. By creating an account, accepting an invitation, or using the service, you enter into an agreement with SKOGHEIM TECHNOLOGIES.

Contracting party

Loylo is operated by SKOGHEIM TECHNOLOGIES, a Norwegian sole proprietorship registered in the Central Coordinating Register for Legal Entities, org. no. 937 840 977, Cort Adelers gate 20, 0254 Oslo. Contact: hi@loylo.io.

Loylo is the product name of the platform. All rights and obligations under these Terms belong to SKOGHEIM TECHNOLOGIES unless otherwise agreed in writing.

The service

Loylo is a platform for digital loyalty clubs, Wallet cards, QR codes, stamps, points, rewards, notifications, automations, insights, and team administration.

Features may vary by plan, configuration, and which third-party services are enabled.

Account and responsibility

You are responsible for keeping information accurate, assigning the right team roles, and using the account lawfully and securely.

The business is responsible for customer data, consent, campaigns, messages, audiences, rewards, and content sent to its own members through Loylo.

Rewards, stamps, points, and campaigns may be changed or ended by the business, but the business is responsible for following its own promises to members and applicable law.

Marketing and consent

By creating an account, accepting an invitation, or signing in to Loylo, you accept that SKOGHEIM TECHNOLOGIES may send product email related to your Loylo account. You can unsubscribe at any time without affecting necessary operational messages.

When a member joins your loyalty club and accepts the terms, the consent covers marketing from your business, sent through the Loylo platform. Unsubscribes take effect immediately and are recorded automatically in the platform.

When you send notifications or other marketing through Loylo, you must have the required legal basis and consent where required by law.

You must respect unsubscribes, deletion requests, and other rights from customers.

Wallet and third-party services

Apple Wallet, Google Wallet, payment services, communications providers, and other integrations are provided by third parties. Loylo cannot guarantee that those services are always available or unchanged.

Members can turn off push notifications and updates from the Wallet card at any time in the settings on their own phone.

You must follow applicable rules from those providers when using the integrations.

Payment and trial

New businesses may receive a 30-day free trial with no card required, as shown in the product. Paid plans are billed monthly according to the selected plan and current prices.

Prices for businesses are normally shown excluding VAT. Payments are handled by a payment provider, and you can manage the subscription from the billing page in Loylo.

You can cancel the subscription at any time. Cancellation usually takes effect at the end of the current paid period, and refunds are normally not issued for a period already started.

When upgrading or downgrading, the payment provider may calculate a prorated adjustment, credit, or charge for the remainder of the period.

If payment fails or a subscription ends, access to paid features may be limited.

Price changes

We may change prices and plan contents. Material price changes for existing paid customers are normally notified at least 30 days before they take effect.

Data ownership and portability

The business owns its own member data and is the data controller for it. When the customer relationship ends, the business may request export of its member data in a machine-readable format, in line with the data processing agreement.

Wallet cards are issued under Loylo's certificates and issuer accounts with Apple and Google. The cards are tied to the Loylo platform and cannot be transferred to other providers. When the customer relationship ends, the cards stop working, and members would need to re-enroll with any new provider.

Aggregated and anonymized data that cannot be linked to a person or an individual business belongs to Loylo and may be used for statistics and product improvement.

Data after termination

When a business is deleted, a backup of the member data is kept for 30 days so the business can request an export. After 30 days the backup is deleted automatically and permanently, and the data can no longer be provided. The business may also delete the backup earlier via the link in the deletion confirmation.

When a business or account is deleted, deletion is carried out by anonymization: personal data about members and users is permanently removed, while anonymized and aggregated data (statistics, transaction volumes) may be retained for accounting, documentation, and product improvement, as it no longer constitutes personal data.

Loylo may retain invoice, security, and agreement data for as long as needed for accounting, documentation, security, or legal claims.

Acceptable use

You may not use Loylo for spam, misleading content, unlawful marketing, abusive content, security attacks, misuse of Wallet cards, or attempts to access data you are not entitled to access.

Misuse, fraud, security risk, unpaid invoices, or legal violations may lead to limitation, suspension, or closure of accounts, cards, stamps, or access.

Intellectual property

SKOGHEIM TECHNOLOGIES owns the Loylo platform, software, design, trademarks, and other intellectual property connected to the service.

The business owns its own data, logos, brand elements, campaign content, and loyalty club content, and grants Loylo the right to use it as needed to provide the service.

Limitation of liability

Loylo is provided as the service is available from time to time. We work for high stability, but the service is provided on a best-effort basis unless otherwise agreed in writing.

To the extent permitted by law, Loylo is not liable for indirect loss, lost profits, or loss caused by third-party services.

To the extent permitted by law, Loylo's total liability under these Terms is limited to the amount the business has paid for the service in the twelve months preceding the claim.

Force majeure

Neither party is liable for delays or non-performance caused by circumstances beyond the party's reasonable control, such as power outages, network failures, third-party provider outages, government orders, strikes, fire, or other extraordinary events. Obligations resume when the impediment ceases.

Changes

We may update the service and these Terms. Material changes will be communicated in a reasonable way.

Governing law and venue

Norwegian law applies to these Terms. Disputes that cannot be resolved amicably are handled by the ordinary Norwegian courts with Oslo District Court as the legal venue, unless mandatory law says otherwise.
